Dear Donal,

Thank you for the Selection Meeting Minutes (reproduced below).

There is one part of the minutes below I am not happy about - which is very important to me, and which I would like to see corrected please.

As I have already pointed out in an earlier e-mail, it is true to say that I was happy with the courteous and orderly way you conducted the meeting last Tuesday.  However, it most definitely is not true to say that I was happy "the proper procedures were being followed" by the Green Party.  Far from it, in fact.

For one thing, I do not really know what the Green Party procedures are - simply because I have not found the time to read them.

Far more importantly, and quite apart from Green Party procedures, I believe the defamatory e-mail Ciaran MacLochlainn published regarding me on April 5th last, which he COPIED to several others, was completely in breach of the "Defamation Act 1961".

The Green Party is not above the law, and neither is Ciaran McLochlainn: regardless of what procedures the Green Party may have.

In law, libel is a CRIMINAL wrong, and actionable per se (i.e. without proof of actual damage suffered).

Once my complaint of criminal activity was brought to the attention of senior members of the Green Party, I believe that - at the very least - Ciaran McLochlainn should have been suspended immediately from his position as "Secretary of the East Galway Green Party": until such time as a full and proper enquiry into my defamation complaint had been completed (by the Green Party).  Please note that my complaint was supported by irrefutable evidence (in the form of the actual e-mail itself, which nobody disputes).

To the very best of my knowledge, the Green Party has not conducted any such enquiry into the defamatory e-mail Ciaran McLochlainn published about me on April 5th.  Consequently, it is my view that the "proper procedures" cannot possibly have been followed by the Green Party regarding this whole matter.

I would ask all concerned to please take careful note of the fact that I first reported the criminal defamation problem to Trevor Sargent (Green Party Leader) and Mary White (Green Party Deputy Leader) on April 6th 2004 - as can clearly be seen from the copy of the e-mail (Sent: Tuesday, April 06, 2004 8:28 PM) reproduced at the following address:
http://www.finnachta.com/FairMurtaghEmail6April2004.htm

I look forward to hearing from you again regarding the alteration I have requested to the minutes reproduced below.

Kind regards,

Billy Finnerty.

Subject: Minutes of Ballinasloe Selection Meeting - Forgive Delay

Minutes and Record of Ballinasloe Local Election Area Selection Meeting 27/4/2004 Gullanes Hotel Ballinasloe 21.00

Present: Una Ní Bhroin, Billy Finnerty, Brendan Kelly, Ciaran MacLochlainn, and Siobhán Nevin

Chair & Minute Taker: Donal O'Bearra RDO

Ballot papers authenticated by the initials DOB1 were passed to 5 present that were on the list of members and a secret voting took place. The ballot papers were collected and counted on front of two witnesses Una Ní Bhroin and Brendan Kelly. The postal ballot were likewise opened and witnessed. The result was recorded on a spare ballot paper on which the Chairman wrote Result.

Result were as follows:

A.     (To Accept)          o Yes 4         o No 6

Do you wish to select William Finnerty as Green Party Candidate?

B.       (To Re-Start)          o Yes 0         o No 8

Do you wish to re-start the Selection Process?

C.      (To Abandon)          o Yes 6         o No 2

Do you wish to abandon the Selection Process without Selecting a Candidate?

D.      (To Defer)          o Yes 0         o No 8

Do you wish to defer the decision to a later date specified by the Selection Meeting?

The Decision therefore was that no candidate would be put forward by the Green Party / Comhaontas Glas in the Ballinasloe LEA. After the results were made known Brendan Kelly asked that the following be recorded:

That he was a representative of the following groups: People against Pesticides, Kilconnell Anti Dump Group, New Inn Anti Dump Group, Friends of Woodlawn House, Monivea Domain Preservation Society, Turoe Celtic Society and The Woodland League. He said in his opinion their views should be taken into account, that they were the grassroots of the Green Party and that he spoke for them. He said that those people that voted for Una Ní Bhroin in the previous general election would be disenfranchised by not having Billy Finnerty to vote for.

Billy Finnerty said that he was happy with the way the Chair conducted the meeting and that the proper procedures were being followed. He asked that the Chair record that he was unhappy with the envelopes and where they came from, that their use was shoddy and not at all satisfactory in the circumstances where the group secretary was opposed to his selection. He also stated that he would probably forget about taking legal action regarding what he saw as defamation if he was selected to run as a candidate for the Ballinasloe rural area. The Chair agreed to record as requested.
