Dear Mr. Geraghty,

Thank you for your e-mail dated January 9th 2003.

I was very pleased to learn that I have not been tried on any charge yet, and that consequently I do not have any conviction.

I note also the information you have provided regarding the Warrant for my arrest which has been issued. Allowing for the contents of the set of four letters referred to under the "Defence Efforts" heading in my letter to you dated January 6th 2003, I feel dismayed by the way this threat is being sustained. Among many other things, it makes my defence much more difficult because my papers relating to the matter are almost all located in the Republic of Ireland.

With further reference to my defence, please note that I believe (very strongly) that I cannot be adequately defended legally unless the Court which hears my case takes full account of the contents of the four letters in question.

For your convenience, I have reproduced the "Defence Efforts" section of my January 6th 2003 letter to you below.

The MAIN reason I did not attend Loughrea District Court on October 9th 2002 was because I strongly suspected that the contents of these four letters would be brushed aside and (in effect) completely ignored by a District Court Judge.

Basically, I see myself as a victim of systematic State corruption (and all the psychological abuse, upset, and damage which goes with it); and, allowing for the fact that I have now been summonsed to appear in Court by the Director of Public Prosecutions (Mr James Hamilton) on a charge of criminal assault, that I cannot possibly get justice unless my evidence of systematic State corruption is rigorously examined by the court which hears my case.

Please note that if this means my case needs to be heard in one of the higher courts above "District" level, this is not a problem for me. In fact, it seems to me that the higher the court, and the more rigorously my evidence of systematic State corruption is examined, the better it would be for my defence.

Much of my evidence of systematic State corruption can be found through lists provided on the front pages of the two Internet web site addresses provided below. (Please note that for technical reasons the www.finnachta.com site is the most up-to-date of the two sites at the present time.)

I look forward to hearing from you again regarding the points I have raised above in connection with the matter of my legal defence.

DEFENCE EFFORTS
(Relating to October 9th 2002 Court Hearing in Loughrea)


(1)  I sent an e-mail letter (backed up by a signed printed version sent through the registered post) to the Director of Public Prosecutions (Mr James Hamilton) regarding the matter on August 17th 2002. The letter in question was copied to the Clerk of the Court in Loughrea (Mr Brendan McDonald). Copies of the text of this letter, together with copies of the five associated Post Office registered letter receipts, can be seen at www page address:

(2) With clear reference to Petition 809/2001, I sought help from the Chairman of the European Union/Parliament Committee on Petitions (Mr Gemelli) in an e-mail letter which was backed up by a signed printed copy I sent to him through the registered post on September 7th 2002. I have not received ANY reply from him (or from any of those who were sent copies). (3) I sent a second e-mail letter (backed up by a printed signed copy) to the Director of Public Prosecutions (Mr James Hamilton) on September 21st 2002 - requesting that the hearing of my case be deferred on account of the fact that I had not received any reply from Mr Gemelli. Please note that in Section E of this letter I pointed out to the DPP that I had no intention WHATSOEVER of appearing in court unless I was in receipt of a satisfactory written reply from Mr Gemelli to my letter to him dated September 7th 2002.

Also in section E of the same letter, I made it clear that I had decided not to spend any more of my time and money trying to find Republic of Ireland lawyers who might help me: unless Mr Kenneth Murphy (Director General of The Law Society of Ireland) replied to the two letters I sent to him through the registered post some months earlier. (4) I sent a third e-mail letter (backed up by a signed printed copy) regarding the matter to the Director of Public Prosecutions (Mr James Hamilton) on September 28th 2002 - pointing out (among several other things) that I intended to leave the country in circumstances where he appeared to be unwilling to defer the hearing of my case to a later date. At this stage Mr Hamilton had of course already been informed about the difficulties I was having with finding a defence lawyer: e.g. that I had not received any reply from Mr Gemelli, or from Mr Murphy - as referred to above.
