Dear Mr. Geraghty,

Thank you for the letter dated October 10th 2002 which you sent to my Republic of Ireland address. Thanks also for the help you provided in Loughrea District Court on October 9th 2002.

As I have been living at different addresses outside of Ireland since October 8th last, I did not manage to actually see the contents of your letter until very recently - after my half-sister Ms Margie Dolan (who lives near my brother Mr Gerald Finnerty in New Inn village) sent a copy of it to me at my present temporary address in England.

With reference to the matter of I having "some legal defence" (as you have put it), please note that although the Judge seems to have given no hint of it in Court (judging by your brief account of what took place on the day), I did in fact try VERY vigorously to defend myself in the weeks leading up to the court hearing on October 9th 2002; and, that it was only when all of the people I wrote to seemed to be completely ignoring my letters that I finally decided it would be unwise (and unsafe possibly) for me to remain any longer within the Republic of Ireland jurisdiction. Basically, I felt that I was being lined up (in a sly and insidious way) for a corrupt and malicious criminal conviction for assault.

Those I wrote in the weeks leading up to my court hearing on October 9th 2002 included the Director of Public Prosecutions (Mr James Hamilton), the Chief of Police (Commissioner Pat Byrne), Prime Minister Ahern, President Mary McAleese, the Chairman of the European Union/Parliament Committee on Petitions (Mr Gemelli), and - last but not least - the Chief Clerk to Loughrea District Court (Mr Brendan McDonald). Details of my efforts, including scanned copies of the Post Office registered letter receipts associated with the several letters in question, can be found by looking in the section I have included below under the heading: "Defence Efforts".

My friend Mr ****** has informed me that he approached you in Loughrea Court House on October 9th 2002 because he was very concerned about the way my brother (Mr. Gerald Finnerty) seemed to be so worried at the time. I was very pleased to learn that Mr ****** sought your help, and that you responded in the way which you did.

Please note that my brother had all along given me the impression that he did not need to attend the Loughrea Court hearing on October 9th 2002. As I pointed out in paragraph 10 of the letter referred to below dated September 28th 2002 to the Director of Public Prosecutions (Mr James Hamilton), I had sent copies of correspondence containing outline information relating to my October 9 2002 court hearing by hand (via my half-sister and psychiatric nurse Mr William Ward) to consultant psychiatrist Dr Anne Jeffers of the Western Health Board. (My brother and half-sister have both been under the care of Dr Jeffers for a number of years now, and Mr Ward normally visits them both in New Inn on a very regular basis every second Friday.)

When my brother gave me the impression that he had NOT been asked to attend court, I tended to assume that Dr Jeffers must have lawfully intervened in some way which made it unnecessary for him to be present in Loughrea Court on October 9th last. Some weeks after the event, my half-sister informed me that my brother was so upset and worried about having to appear in court that he could not bring himself to talk to anyone about it. (Please note that it was precisely because of this known tendency of my brother not to talk about things which are troubling him that I took steps to ensure Nurse Ward and Dr Jeffers were both aware of the general situation.)

If, after considering the overall nature of my legal difficulties, you feel you can provide me with any further legal help I would be very pleased to hear from you again.

The two questions which I would most like answers to at the present time are:

1)  Do I now have a criminal conviction for assault? - as a result of I shouting at Mr Hoey (of Galway County Council) following his complete refusal during the run-up to last May's General Election in the Republic of Ireland to take a look at the illegal sewage discharges (from the Primary School) which were going into the air, and into the river, right in the middle of New Inn village. Please note that at the time I asked him, Mr Hoey was at my brother's business premises - which is just 50 yards or so from the illegal air and water discharges in question.  As you may already know, the purpose of Mr Hoey's visit was to complain about a sign I had just erected which contained the address of an Internet web site. Much of the contents of the web site ( www.finnachta.com ) involved information on the high levels of corruption in the Republic of Ireland: information which (for the most part) the normal media appeared to be ignoring in the run-up to the election.

2)  With regard to the warrant which has been issued for my arrest on October 9th 2002, and the fact that you have to be notified regarding its execution, what exactly does this mean, in practical terms, if I re-enter the Republic of Ireland jurisdiction? (With regard to this particular question, please note that the only home I own, and almost all of my possessions are at present located in New Inn village.)

DEFENCE EFFORTS
(Relating to October 9th 2002 Court Hearing in Loughrea)

(1)  I sent an e-mail letter (backed up by a signed printed version sent through the registered post) to the Director of Public Prosecutions (Mr James Hamilton) regarding the matter on August 17th 2002. The letter in question was copied to the Clerk of the Court in Loughrea (Mr Brendan McDonald). (2) With clear reference to Petition 809/2001, I sought help from the Chairman of the European Union/Parliament Committee on Petitions (Mr Gemelli) in an e-mail letter (backed up by a signed printed copy I sent to him through the registered post on September 7th 2002).  I have not received ANY reply from him (or from any of those who were sent copies). (3) I sent a second e-mail letter (backed up by a printed signed copy) to the Director of Public Prosecutions (Mr James Hamilton) on September 21st 2002 - requesting that the hearing of my case be deferred on account of the fact that I had not received any reply from Mr Gemelli. Please note that in Section E of this letter I pointed out to the DPP that I had no intention WHATSOEVER of appearing in court unless I was in receipt of a satisfactory written reply from Mr Gemelli to my letter to him dated September 7th 2002. 

Also in section E of the same letter, I made it clear that I had decided not to spend any more of my time and money trying to find Republic of Ireland lawyers who might help me: unless Mr Kenneth Murphy (Director General of The Law Society of Ireland) replied to the two letters I sent to him through the registered post some months earlier. (4) I sent a third e-mail letter (backed up by a signed printed copy) regarding the matter to the Director of Public Prosecutions (Mr James Hamilton) on September 28th 2002 - pointing out (among several other things) that I intended to leave the country in circumstances where he appeared to be unwilling to defer the hearing of my case to a later date. At this stage Mr Hamilton had of course already been informed about the difficulties I was having with finding a defence lawyer: e.g. that I had not received any reply from Mr Gemelli, or from Mr Murphy - as referred to above.
